Is Delta-8 THC legal in South Carolina and North Carolina?

Ah, one of our most common questions. I’m going to try and answer this and a few other questions for you today, so that we all can spread a little knowledge to those who seek it.

This question can be answered in just a few words; The 2018 Farm Bill. When this bill was signed into law in 2018, it federally legalized all products derived from hemp which contain less than 0.3% Delta 9-THC (the illegal form of THC). And with significant advances in the science surrounding hemp, scientists and extractors have learned how to concentrate the Delta 8-THC content in hemp extracts while at the same time minimizing the Delta 9-THC content to under the legal limit. This leaves us with an extract , technically a distillate, that is anywhere from 90%-98% pure Delta 8-THC, while keeping the Delta 9-THC percentage at essentially 0%.

“So neat, Delta 8 is legal because it has less than 0.3% Delta 9-THC, but how does it come from hemp? I thought hemp was just CBD.”

Well, we start with our purebred and exceptionally high quality hemp flower, and extract the CBD oil with our CO2 extraction process, which yields oils in excess of 90% purity. From there our oil undergoes a process called reisomerization, which, for lack of a simpler term, transforms CBD to Delta 8-THC.

 

There are also more exotic varieties of Tetrahydrocannabinol (THC) such as THC Delta 0 and THC Delta 10. Chemically, it is only the position of the double bond that distinguishes them from one another.

“So great, Delta 8 comes from CBD, and CBD from hemp, and if it’s got less than 0.3% Delta 9 THC in it, that means it’s legal. But what does it do? What do the effects feel like?”

Well to answer that you’d need to know how you dosed yourself in this hypothetical situation. Most commonly, people would smoke or vape their chosen cannabinoid. At that point your dose is being absorbed thru your lungs and will reach your brain very quickly. The effects will only be moderately sustained however, in other words, will not last very long.

Let’s say, however, that you dosed yourself orally, and you ate one of our world-renowned gummies? Well that 30 milligrams of high-quality Delta 8 concentrate that’s infused into every one of those ridiculously tasty gummies, will lurk in your belly, waiting to for the perfect moment (about 25-45 minutes in the future) to brighten your day and reduce your anxiety and pain into nothingness. These effects will persist for 3-5 hours and taper off slowly.

Delta 8 is vastly superior to Delta 9 because it is only half as strong. That way, if you need to get “higher” just take more!

It also boasts anxiety reducing qualities, so if you’re still experiencing anxiety your dose may not be large enough.

It has also been shown to induce appetite, which is helpful for patients who may find trouble eating.

The next question that comes up is “Well, what if I get caught with this?”

Well, the answer is delightfully simple. As you are doing nothing illegal, there’s absolutely nothing to worry about. However, we know that situations do arise, and so we have provided a QR code on all of our Delta 8 products that bring up all the lab results any diligent officer might require.

The next most common question we get is not a question at all, but a comment, which is as follows:

“That’s not real weed.”

To which I would like to respond, good sir, with a resounding:

Duh.

A 66-year-old Caucasian female presented for an orthopedic surgery, more specifically a trapeziectomy, to repair years of damage from osteoarthritis. Despite this typically being a very painful condition she reported no pain before the operation. The operation went well and post operation she again reported her pain as 0/10. Even after her analgesics had worn off, she reported no pain during recovery or during IV manipulation. Additionally, she was diagnosed with severe osteoarthritis of the hip, which she reported as painless. After the painless trapeziectomy surgery and a history of ‘painless operations’, she was referred to and further investigated by pain genetics teams from University College London and the University of Oxford at age 67 years (Habib 2019).

Genetic analysis revealed the she had inherited a microdeletion and FAAH hypomorphic SNP allele. This caused her to lose the normal function of FAAH, which an enzyme that degrades anandamide (AEA), palmitoylethanolamide (PEA), oleoylethanolamine (OEA), and 2-arachnidonoylglycerol (2-AG). More on these endocannabinoids to come. This was further investigated with blood samples which showed, circulating concentrations of AEA were increased by 70% and of OEA and PEA approximately tripled compared to normal.

So, lets review what we have so far. FAAH is an enzyme in our bodies that breaks down endocannabinoids in our body, this is a normal process. These endocannabinoids are AEA, PEA, and OEA. Endocannabinoids are molecules inside our body that look like molecules found in cannabis. Plant based cannabinoids were discovered before the cannabinoids found in our body, hence why molecules in our body are named after cannabis. Anandamide (AEA) has roles in nociception, fear-extinction memory, anxiety, and depression (Habib 2019). Nociception is the scientific word for feeling pain.

Now you are probably thinking I need to get this FAAH enzyme out of my body and I can be living pain free, anxiety free, and depression free. Well science is just gaining the ability to edit your genes, however there is an easier way. CBD will also increase endocannabinoids in your body. Simply by incorporating CBD in your daily routine you can be happier, feel less pain, and have less anxiety.

This is the process which we remove the beneficial oils from the hemp plant. The typical gaseous state of CO2 is altered by applying pressure and heat. The new liquid-gas hybrid state is then able to gently extract CBD and other oils from the hemp plant. Once the solution returns to room conditions, the CO2 leaves the solution, like a soda going flat after its opened. The extraction with pure carbon dioxide provides the final product with no solvent as carbon dioxide is evolved and thus removed during depressurization (Tyśkiewicz 2018). This final product contains all the oils from the plant including CBD, CBG, CBC, CBN, CBT, terpenes, and flavonoids. All these oils have benefits on their own, however together they act synergistically, also known as the entourage effect.
Ethanol and Butane/Propane extraction methods use chemicals you wouldn’t want to ingest. Additionally, these extraction methods destroy some of the terpenes in the extract, potentially making the final product less robust in flavor.
The positives of CO2 extraction coupled with the negatives of other extraction methods leads to the conclusion that the consumer should be aware of what extraction method was used in creating the CBD that they are consuming. At best, they are consuming an inferior product with the older extraction methods, at worst, the product has cancer causing byproducts and residual solvents. So please, research where a company’s products were made and what extraction process was used.

The passage of the Farm Bill in 2014 led to the end of prohibition of hemp and the birth of a new industry. As you’re probably aware, the hemp plant has an unfathomable number of uses and certainly unimagined potential applications.
Once the hemp plant has fully matured and flowered, we remove the flowers by hand and grind them into a powder. This powder is then packaged into a CO2 Extractor, in order to strip the grinded hemp flower of the oils. The oils that are removed include CBD, CBG, terpenes, and flavonoids; among others. While CBD is very beneficial on its own, its effects are synergistic and amplified with the presence of the other cannabidiols, terpenes, and flavonoids. This bulk CBD oil is then distilled in order to further refine the oil and remove unnecessary waxes.
